摘要

休谟的正义思想具有独特的标志性，他颠覆了苏格兰传统，形成了较为系统

的情感主义人性学说，对于正义的产生条件、正义与美德、财产权的产生及其论

证方法都具有其独到的见解。本文将按照休谟正义思想的逻辑主线对其进行解析，

并阐述其论证方法及其对现实的启示。

休谟发展了前人的正义思想，建立了情感主义人性说，肯定了同情的作用，

并认为正义是为解决外部自然资源有限性和内部人类自私情感的双重威胁而产生

的。而自私作为人的本性是很难改变的，因此，有关正义稳定和维护人类资源占

有的财产权的问题便极为重要。正义具有的不平等性，可以保障个人财产的稳定

性和合法性。同时注重法律制度对正义原则的保障，使正义原则有法可依。

对于正义理论的建构，休谟认为正义是作为一种人为的美德，是为解决道德

的现实实践意义而产生的美德原则，是具有前提预设的人类协议，以弥补自然之

德不具备的规划性和意向性。作为正义的作用范畴的财产权，休谟表明了其正义

确定了个人对财产的占有的权利和对他人财产表示尊重的义务，是作为互利认可

的行为关系和原则。这里，财产权诉诸的不是一个人与物之间的关系，而是人与

人之间的关系，是一个道德问题，人权问题。

休谟其独特的正义思想是离不开其论证方式的。人性自私与对公共效用的同

情两者间的共同作用作为正义起源的心理机制，形成了获得赞许的正义道德感。

贯彻人为之德的“人为设计”作为正义的演绎方式，是作为对于社会环境中不利

条件的一种“人为补偿”方式。正义措施得到公认后，将引发公众正义感，并形

成切实可行的社会规则制度。

休谟正义思想虽有局限性，但对构建我国社会主义和谐社会以及促进社会主

义市场经济仍有重要启示。我国财产权的确立对人权的保护、法治文明的推进和

增进社会和谐具有重大意义。以人的需求与感受为落脚点，在社会环境中积极协

调道德情感与社会制度之间的关系，使两者和谐共建，促进我国社会的健康发展。

Abstract

Hume's idea of justice has a unique landmark. Hume, who subverts the Scottish

tradition and formed a systematic theory of the human emotion socialism, has his own

unique insight on the origin of justice, artificial virtue, and how property rights generate.

This article will follow the logic of Hume's Idea of Justice and the main line to explain

its demonstration methods.

Hume who developed the previous thoughts of justice, established the human

emotion socialism and affirmed the role of sympathy, think that justice is a dual threat to

the solution of the natural resources and human selfish emotions. The problem on

justice stabilizing and maintaining the possession of human property rights will be

extremely important. Inequality of justice can protect the stability and legitimacy of the

personal property.

Hume thinks justice is a artificial virtue, which incarnates the practical significance

of moral. Hume's theory describes the rights of the possession of personal property, and

obligations of respect property of others. Here, resort property is not a relationship

between persons and things, but the relationship between peoples more like a moral

issue, and human rights issues.

Hume's unique thoughts of justice are inseparable from his demonstration methods.

The psychological mechanism of the origin of justice, which is the interaction between

human selfishness and its sympathy to the public utility, forms the moral sense of justice

of approval. As a way of interpretation of justice, "Human Design" expressing artificial

virtue is a way of" Human Compensation "to the disadvantage of the social sentiment.

When justice measures have been recognized, it causes the sense of public justice, and

finally forms a practical system of social rules.

Hume's powerful theory has a significant role on the construction of the

harmonious society and market economy. The generation of property rights, is of great

significance to the protection of human rights. And，base on the demand and feeling of

human being, coordinating the moral emotions to the social system can make a positive

society .
