摘 要
在我国社会转型期,随着市场经济的快速发展,就业方式也发生了很大的变
化。劳务派遣这种新型就业方式就是这种变化之一。它以其独特的优势得以迅速
发展,劳务派遣工人数在不断扩大,作用亦非常显著,同时劳务派遣带来的社会
保险等问题也开始凸现。但是由于劳务派遣制度建立的时间不长,因此对于这一
制度带来的社会保险问题的研究还处于起步阶段,劳务派遣中有关社会保险的纠
纷屡屡发生。如何解决这些问题,更好地完善劳务派遣工的社会保险制度,不仅
关系到劳务派遣工自身的权益保障,而且对劳务派遣就业方式以至整个就业环境
和劳动关系的和谐稳定都至关重要。
本论文紧密联系我国实际,依据准双重劳动关系等相关理论,运用规范研究
和实证研究相结合的方法研究我国劳务派遣制度带来的社会保险问题。首先以劳
务派遣工社会保险的理论分析为出发点,从探究劳务派遣工社会保险的理论基础
着手,阐明劳务派遣的内涵,探源劳务派遣工社会保险的相关理论,以及完善我
国劳务派遣工社会保险的必要性;其次以我国劳务派遣工社会保险的现状作为深
入分析的切入点,系统地分析了我国劳务派遣工社会保险方面存在的问题和成因;
然后以新颁布的《中华人民共和国劳动合同法》为分析对象,分析和研究《劳动
合同法》对劳务派遣工社会保险的保护力度,并指出其不足之处;最后通过对目
前我国劳务派遣工社会保险存在的问题及《劳动合同法》中不完善之处的分析研
究,有针对性地提出进一步完善我国劳务派遣工社会保险的措施,以期更好地保
护劳务派遣工的合法权益。
劳务派遣制度是我国近年来出现的一项新的劳动用工制度。本文旨在通过对
劳务派遣制度中出现的劳务派遣工社会保险这一区别于其他用工方式的新问题进
行分析,提出解决这些新问题的措施,为规范劳务派遣制度和保障劳动者权益提
供理论依据。本文的创新之处主要表现在:首先,在对准双重劳动关系理论分析
的基础上,运用这一理论对劳务派遣中的三方劳动关系进行梳理,明确了各自在
劳务派遣工社会保险领域的责任,三方责任的划分有助于避免责任的相互推委及
更好地履行该制度。其次,对异地派遣中存在的社会保险缴费基数确定方面的道
德风险进行了分析并提出解决措施。这个问题是其他用工方式都不存在的,因此
具有其独特性,又是新出现的问题,法律规范在这方便还比较欠缺,也没有其他
规定可以参考,所以探讨解决这个问题的办法有利于保障劳务派遣工的社会保险
权益。最后,本文还通过对同工同酬理论的分析,引申出了同工相同社会保险待
遇这一命题,针对劳务派遣中普遍存在的同工不同社会保险待遇现象,提出有针
对性的解决措施。

ABSTRACT
During the transition of our society, together with the rapid development of market
economy, modes of employment have undergone dramatic changes. Labor dispatching,
a new mode of employment, is developing at an unprecedented speed with its own
specific characteristic, and the population of labor dispatch employees is increasing.
However, the issue of social security concerning labor dispatching arises. The research
on the social security of labor dispatch employees is still on the first stage. The dispute
on the social security of labor dispatching is always on due to the inadequacy of the law
and the rules. Therefore, how to overcome these problems in order to perfect social
security has not only something to do with their rights’ protection but also with the
modes of employment as well as the harmony of the whole employment environment
and labor relation.
According to some relevant theory such as prospective dual labourthis essay
closely relates our country’s situation and use the method of the combination of
normative research and empirical studies to study the social security of our country’s
labor dispatch employees. First, from the starting point of the analysis of labor dispatch
employees theory, and studying the basis of the social security of labor dispatch
employees, it aims to elaborate the conception of labor dispatching, search for the
relevant theory of labor dispatch employees and find the necessity of perfecting social
security; Second, from the cutting point of current social security of our country’ labor
dispatching, this essay analyzes the current problems and factors concerning the social
security of labor dispatch employees; Third, taking the new issued Law of Labor
Contract of People’s Republic of China as an example, it analyzes the protection
enforcement it exerts on the social security of workers and points out its weakness;
Fourth, it puts forward some measures to protect the social security of labor dispatch
employees. Through the analysis of the current problems of the social security of labor
dispatch employees, this essay further puts forward some measures to perfect the social
security so as to protect workers’ rights.
The innovation of this essay is to use the theory of prospective dual labour
relations to make the three labor relations of the labor dispatching and the responsibility
of each in the field of the social security. The division of the responsibility contributes
to the implement of the rules. Secondly, we put forward some measures to the unclear
phenomenon of the pay of the social security existing in the labor dispatching. The
