摘要
中国改革开放 30 多年来,国民经济和社会发展取得了巨大进步,国家综合国
力显著提高,人民群众物质文化生活明显改善,社会从整体上和谐地向前发展。
当前,以人为本,尊重和保障人权,己成为中国各项工作和建设事业的出发
点和落脚点。随着构建社会主义和谐社会目标的提出,保障人权的问题成为了题
中之意。而伴随着我国社会主义市场经济的发展和社会结构的急剧转型,许多人
权侵害问题的凸现,保障人权问题更显得迫在眉睫。尤其是在我国非公有制企业
中,企业职工的权利更是得不到应有的保障。而企业是经济社会的细胞,是经济
社会发展的主体和重要力量,承担着物质财富创造的责任。当前,我国非公有制
企业在我国占有重要的地位。非公有制经济作为我国社会主义市场经济的重要组
成部分,在剩余价值的创造中也占有十分显著的地位,发挥着举足轻重的作用。
而非公有制企业职工是物质的直接创造者。非公有制企业职工的权利如果得不到
有效的保障,很容易引起像“民工荒”这类现象,致使制造业和餐饮服务一些岗
位出现结构性缺工。企业招不够需要的人数,进而影响企业的生产、经营,甚至
影响社会的稳定与发展。
我国是社会主义国家,如何更好地维护广大工人的权益,保护他们的利益,
是我党和政府一直在积极探索、关注的焦点问题。本文基于此,从马克思主义的
无产阶级人权理论研究出发,联系现实,分析目前我国非公有制企业职工人权保
障的现状,在肯定目前我国保障职工人权取得的成就的基础上,对我国非公有制
企业职工人权保障中仍然存在的问题,以数据为依据,详加论述。本文认为,当
前在我国非公有制企业职工的工作生活中,他们的政治权利、经济权利和社会权
利得不到切实的保障。并进一步就所列出的问题出现的原因进行了分析。当前之
所以会出现这些问题,主要是因为人权法制建设不健全、人权保障政治方面制度
不完善、企业雇主及企业职工人权保障观念淡化以及相关社会保障措施不健全
清楚问题的原因所在,才能更好地提出解决问题的方法,更有效、针对性地解决
问题。对如何解决问题,保障非公有制企业职工的人权,本文从制度建设层面提
出了自己的建议。从四个层面:政治制度保障层面,伦理道德保障层面,法制建
设保障层面,社会建设保障层面来入手进行建设。通过以上的分析探讨,为我国
非公有制企业职工人权保障问题的解决提供参考意见,推进我国人权事业在这一
方面的进一步发展。

ABSTRACT
China's reform and opening up more than 30 years, our country’s economic and
social development has made enormous progress, the overall national strength
significantly increased and the people's material and cultural life is improving
remarkably and social harmony in the overall progress.
At present, the concept of People-oriented and respect and safeguard human rights
that has become the starting point and target in all work and construction in China. A lot
of human rights are violated that it highlights the problem with the development of
China's socialist market economy and rapid transformation of social structure. It is more
urgent to safeguard the human rights. Especially in non-state owned enterprise that
workers cannot to get the due guarantee more. However, Enterprise is the cell of
economy society, the main body and the important strength to economic. Enterprise is
bearing the responsibility that they create the material wealth. Currently, non-state
owned enterprise occupies the important effect in our country. Non-state owned
economy as make an important part in China's socialist market economy. It is also
occupies the important position in surplus value which they created. The employees of
non-state owned enterprise are creator in direct. If the rights of employees can not be
safeguard well, it is will cause the bad phenomenon that affect the production, operation,
and even affect the social stability and development.
China is a socialist country. My party and the government has been actively
explored the problem the how to better safeguard the rights of workers and to protect
their interests. We have analyzed the status of human rights protection of employees in
non-state owned enterprises in current that based on Human rights theory studies of
Marxism and Contact reality. We have discussed the problem that human rights ensure
of employees in non-state owned enterprises in detail that go ahead in the basis
affirming the accomplishment that we have guaranteed human rights of the workers get
at present. This paper argues that the employees of non-state owned enterprises in China
that rights are not effectively protected include the working life, the political rights and
the economic rights and so on. This article analyzed the cause of the problem in further
and made many proposals and proposed four dimensions of their own proposals on how
to solve the problem and protect the human rights of non-public enterprise employees.
Through the above analysis and discussion, to provides the advisory opinion for human
rights of employees in non-state owned enterprises and promote the development of the
