基于委托代理视角的我国工伤保险事故预防机制研究

摘 要
工伤保险制度是社会保障制度的重要组成部分,工伤预防作为工伤保险的基
本功能,随着社会的发展逐渐凸显出来。工伤预防是通过采用管理和技术等手段
对工伤事故以及职业病事先进行防范,消除工伤事故及职业病的隐患,减少工伤
事故、职业病的发生,因而在保护劳动者的安全和健康、促进经济发展、维护社
会稳定方面发挥着重要的作用,也越来受到各国的重视。
我国的工伤保险事故预防工作,随着我国经济快速发展不断得到改进。但是,
目前我国工伤事故和职业病的形势依然严峻,工伤预防的作用没有得到充分发
挥。我国工伤预防依然存在法律规定不明确、监管体制不健全、费率机制不完善
等诸多问题。制约了科学有效的工伤预防机制的形成。
本文从委托代理理论的视角出发,分析我国工伤保险事故预防体系中存在的
问题及其原因,借鉴国外成功的治理经验,结合我国的国情来探讨完善我国工伤
保险事故预防体系的对策。文章共有四个部分:
第一部分主要是工伤保险事故预防和委托代理理论的概述和二者之间的关
系介绍,以及行文思路、研究方法和创新点。
第二部分主要对我国工伤保险事故预防的发展状况进行研究。首先研究了工
伤保险事故预防在我国的发展情况,接着分析了其中存在的委托代理问题,在此
基础上,进一步分析了阻碍我国工伤保险事故发展的症结所在。
第三部分通过对德国工伤保险事故预防的发展历程研究,分析其对工伤保险
事故预防中的委托代理问题的治理,并通过中德两国的国情比较研究,找出适合
完善我国工伤保险事故预防的经验借鉴。
第四部分从委托代理理论的视角出发,主要从强化工伤预防的监督与约束、
完善激励机制、建立联动机制方面,对完善我国工伤保险事故预防的对策进行探
讨。

ABSTRACT
Work injury insurance system is an important constituent of social security
System. As one of the basic functions of work injury insurance,Work-related injury
prevention emerged with the gradual development of the society. Through the use of
management and technology and other means, work-related injury prevention can
prevent the occupational accidents and occupational diseases in advance, eliminating
occupational accidents and diseases risks, reduce accidents, occupational
diseases.Thus it plays an important role in protecting the safety and health of workers,
promoting the development of economic,safeguarding the social stability. And many
countries pay more and more attention on it.
The work-related injury prevention system in our country has made great
progress as the stably development of China's economy.but at the same timethe
situation of work accidents and industrial diseases is very serious. The function of
work-related injury prevention has not been brought into play effectively. It still have
many programs, such as work-related injury prevention attaches importance to
compensation but makes light of prevention, the ambiguous lawimperfect regulatory
system, defective rate mechanism.These negative factors has restricted the generation
of preventive mechanism of work-related injury.
The paper is based on principal-agent theory, points that the authorities of the
injury prevention-the government, and the implementation of the sector - enterprises,
has principal-agent relationship and principal-agent risk. From this point of
view,Analysis the problems which caused in the work-related injury prevention
mechanism. learn from the successful management experience from abroad,
combined with China's specific national conditions to explore the solutions and
measures in the principal-agent risk for injury prevention mechanism.Then put
forward some reasonable proposals for the mechanism of injury prevention.
The first part outlines the theory of work-related injury prevention and
principle-agent their relationship,thought in writing,research method and the
innovation point of this thesis.
The second part studies the development of work-related injury prevention
system in China.It first describes the work-related injury prevention system in
China,and then finds the existing principle-agent problems.On this basis,it analyzes
the crucial reasons that block the way.
The third part studies the development of work-related injury prevention system
in German.analysis the management experience of principle-agent problems in its
work-related injury prevention system.and through comparative study between China
and Germany's national conditions,to further develop the system of work-related
injury prevention.
The last part draws a conclusion that taking the specific measures to perfect and
improve our country's work-related injury prevention system from the aspect of
principle- agent theory.
