浅谈住宅小区物业管理纠纷的若干问题

摘要
物业管理在我国是一个新兴行业,虽起步较晚,但发展迅速。近年来,小区
物业管理纠纷呈上升趋势,主要表现在业主不满物业管理公司的服务而拒交物
业管理费和物业管理公司收费项目、范围、标准不明确或收费过高等方面。因此
研究物业管理中的纠纷对完善我国物业管理的水平有重要的意义。本文首先对物
业管理主要概念、发展趋势、服务内容及既存问题进行了分析,然后从住宅小区
物业管理纠纷的产生、类别及纠纷产生的原因进行了分析,对住宅小区物业管理
服务不规范、开发建设中的遗留问题、业主缺乏自律且业主大会和业主委员会运
作不规范、物业管理服务收费与服务需求差距不断加大、其它社会问题、相关部
门协调性差、法律法规不完善、社会对物业管理的认识理解不够等八方面导致纠
纷产生的原因以上海市纠纷实例进行了分析;最后结合前述研究,提出了相关
主体方面加强行业自律,推进企业诚信建设,物业管理企业要强化服务意识,
增强沟通。业主的民主、法制、理性意识有待提高;切实做好物业矛盾纠纷调处
等对策措施。

Abstarct
Property management in China is an emerging industry, though started late, but growing rapidly.
In recent years, residential property management disputes is rising, mainly at the owners
dissatisfied with the services of property management companies refused to pay the property
management fees and property management company fees, scope, standards do not explicitly or
high charges and so on. Therefore, the management of property disputes on the Improvement of
the level of property management has an important significance. In this paper the main concepts of
property management, development trend, services and pre-existing problems were analyzed, and
then from the residential district property management disputes arise, category, and the causes for
disputes are analyzed, Residential property management, development bulidinglegacy, the owners
have little self-discipline and owners and convention Owners Committee Yunzuo Bugui Fan and
property management service Shoufei and services the increasing gap between, other social
problems, related poor sectoral coordination, legal or regulatory system, community management
of his property eight aspects of such knowledge is not enough understanding of the causes leading
to disputes in Shanghai dispute case analysis; Finally, the aforementioned research, the main
aspects related to strengthening industry self-regulation, advancement of enterprise credit
construction, property management companies to enhance service awareness, and enhance
communication. Owners of democracy, rule of law, rational sense to be improved; really good job
in mediation of property disputes, conflicts countermeasures.
