摘要
根据目前上海市住宅小区的物业管理行业还存在的制度建设不完备、法律法
规缺失、行政执法力度不够、物业专项维修资金管理工作松懈、业主和物业管理
公司观念滞后及双方行为欠妥、物业管理公司与相关职能部门关系有待理顺等诸
多问题,结合当前物业管理形势的发展,探讨如何充分开发利用物业管理的资
源,并就“建管不分”和建设单位遗留问题、社会对物业管理的认识存在误区、
业主理性维权、物业管理收费问题矛盾突出、物业管理公司自身存在问题、物业
管理双向选择机制还未建立等问题,找出解决的办法及采取相应的措施和对策
进行解决,最终形成有利于物业管理发展的良好环境,以适应当前房地产业快
速发展中业主对物业管理资源的广泛需求。研究中,重点对上海市住宅小区物业
管理存在的实际问题进行调查,分析问题产生的具体原因,认清上海市住宅小
区物业管理的形势,提出上海市住宅小区物业管理的总体发展思路,并就加快
上海市住宅小区物业管理的发展,进一步探索规范上海市住宅小区物业管理的
发展对策。

Abstract
According to the current Shanghai Residential residential property management
industry is still not complete construction of the existing system, lack of legal

management fees outstanding conflicts and problems of property management
