论我国劳动力市场集体谈判制度——基于公民身份理论视角

摘 要
集体谈判制度是现代市场经济国家调整劳动关系的重要机制,也是全球化背
景下规范劳动关系的重要手段。改革开放以来,我国社会主义市场经济得到了飞
速的发展,但在肯定成就的同时不能忽视问题的存在。我国劳动关系的内在不平
衡--资强劳弱--的现象随着私有化改革变得越来越明显,劳资冲突不断出现,特
别是集体劳动争议事件频发,这在一定程度上对社会的稳定造成了威胁。随着这
些问题的出现,我国政府和社会伙伴越来越重视集体谈判制度的改革与发展,并
将集体谈判制度以及工会的改革作为稳定我国劳动关系的重点项目。
作为改革集体谈判制度的关键方面,劳动者的权利意识在近年来得到了很大
的发展,并且有意识地开始组织起来维护自身的利益。我国学者关于这方面的研
究主要集中在劳动者的人权以及尊严,一般以个人劳权和集体劳权的立法和实施
作为研究的重点。而公民身份理论的三个权利维度则是公民自身一般所应具有的
权利,这种权利的具备是基于现代民主社会而言的,其中的公民权利更是针对市
场经济的有效运行而有了历史性的发展。面对我国当前的劳动关系现状,必须在
改革集体谈判制度的基础上,寻找更加切实可行的理论进行结合研究,以促进我
国劳动关系的和谐发展。本文将社会学中的公民身份理论结合集体谈判制度进行
现状分析,并提出了相关的研究对策,希望可以对我国集体谈判制度的进一步发
展贡献力量。
本文运用文献分析法和比较分析法,以社会学理论、福利经济学理论以及管
理学的相关理论为基础,分析了公民身份理论在现实中的发展情况、我国集体谈
判制度的发展现状以及对我国经济社会发展的影响等。本文还以美国的集体谈判
制度为比较和借鉴的对象,分析了两国制度以及实施之间的不同之处,罗列出了
可以进行借鉴的方面。同时针对我国集体谈判制度存在的问题,提出了相关的政
策建议。
值得一提的是本文还分析了与集体谈判制度并存的,发展于 20 世纪 60 年代
美国的就业权力制度,从全局的角度研究了这种制度与集体谈判制度之间的关系
和彼此的影响。而在提出建议部分,也对集体谈判制度与就业权力制度、人力资
本产权制度之间的相互促进发展上进行了相关的分析和建议,希望可以对我国劳
动关系的改善和发展提供新的思路。
集体谈判制度是劳动力市场运行的重要条件,而劳动力市场的稳定是我国市

场经济发展的基本要件。它的完善需要政府的正确领导和社会的广泛关注,加强
集体谈判的立法,同时加强工会的自身建设,创新工会维权的手段和方法。我国
劳资冲突的解决已经到了刻不容缓的程度,必须集中力量进行集体谈判制度的建
设,缓解紧张的劳资关系,促进我国社会主义市场经济的进一步发展。

ABSTRACT
The system of collective bargaining is an important mechanism in the modern
market economy countries which use to adjust labor relations, and it is also the
important mechanism to regulate labor relations in the context of globalization. Since
the reform and opening up, China's socialist market economy has been the rapid
development, but certainly the success can not ignore the existence of the problem.
Because of the privatization reform, inherent imbalance - the phenomenon of weak capital
forced labor of our working relationship become more and more serious, and labor
conflicts become emerging, especially the frequent incidents of collective labor disputes,
it posed a threat to the stability of the society. With the emergence of these problems, the
Chinese government and the social partners pay more and more attention to the reform
and development about the system of collective bargaining, and regard the reform about
the system of collective bargaining as key projects which could make our working
relationship steady.
Workers awareness of the rights has been a great development in recent years
which is the key aspects of the reform about the system of collective bargaining, and
they started to organize themselves to protect their interests. Chinese scholars make the
research in this area are mainly concentrated in the human rights and dignity of workers,
they also focus on the study about the legislation and the implement of personal labor
rights and collective labor rights. But when we face of the severe labor relation status,
we must base on the reform about the collective bargaining system, and find realistic
theory and put it into study, and then promote the harmonious development of labor
relations in China. In this article, we analyze the situation about the system of collective
bargaining through the citizenship theory in social, and also proposed to the
countermeasures. I hope it could be able to contribute to the further development about
the system of collective bargaining in China.
In this paper, I use of the way of literature and comparative, make an analysis
about the development of the theory in the reality citizenship, the development of the
collective bargaining system in China, the impact of China's economic and social
development issues and so on, the analysis which is based on the theory of sociology,
welfare economics and management science. The article is also compared the difference
in system and the implementation which is about the collective bargaining system

between the United States and China. At the same time, the collective bargaining system
in China proposed the policy recommendations, especially in the system of employment
rights, human capital system of property rights between the mutual promotion and
development suggestions.
The collective bargaining system is a necessary condition of the running of labor
market, and the stability of the labor market is the basic conditions for the development
of China's market economy. The development and improvement about the collective
bargaining system need a widespread concern from the correct leadership of the
government and the social, to make the collective bargaining legislation strengthen,
innovate the means and methods of union rights. China's labor-management conflict
resolution has been to the extent of urgent, we must concentrate our efforts to improve
the system of collective bargaining, ease the tense labor relations, to promote the further
development of China's economy in socialist market.
