摘要

当前，我们正处于信息高速发展的时代，信息已成为人们生活中的必须资源，

政府信息更为重要，因为 80%的有用信息被政府掌握，政府信息公开引起了社会各

界广泛的关注。尤其是当今世界由于各种因素的存在，自然灾害和各种复杂的社

会事件层出不穷，如地震、海啸、禽流感以及各种恐怖事件，这一切更要求政府

及时公开所掌握的信息，增加政府的透明度，使公众能够及时了解事态的发展，

减轻由此产生的恐惧感，增强对政府的信任，从而提高政府的公信力。因此，当

今世界各国政府都加强了对政府信息公开的关注度，把政府信息公开作为政府改

革的核心内容，政府信息公开的研究也成为了国内外学者研究的重要议题。

西方国家信息公开方面无论从理论还是从实践都取得了较大的成就。我国的

政府信息公开制度的研究还处于初始阶段，2005 年，十届人大三次会议上温家宝

总理在《政府工作报告》中谈到“要努力建设服务型政府”时指出：大力推进政

务公开，加强电子政务建设，增强政府工作透明度，提高政府公信力。2007 年 4

月，我国公布了《中华人民共和国政府信息公开条例》，并于 2008 年 5 月 1 日起

实施，可以说是我国政府信息公开建设的一大“里程碑”。该条例提出政府信息“以

公开为原则，不公开为例外”，最大限度公开政府信息，体现政府履行监管和服务

的职能，并将对政府公开信息做强制性规定。上海市从 2004 年出台了《上海政府

信息公开规定》，开始试行政府信息公开，至今已有五年的时间，在这五年里，取

得了较大的成效，但和国外政府信息公开相比还有一定的差距。

本文首先从政府信息公开的概念、基本理论入手，指出政府信息公开在促进

经济发展、实现人民当家作主、提高政府公信力、防止腐败、推进依法行政和改

革政府管理方式方面具有重要的意义。其次对目前上海政府实施政府信息公开的

现状进行分析，上海在组织体制、配套制度等方面都取得了一定的成效，但在公

开内容的深度、监督体制的完善、电子政府的建设等方面还需要进一步改进。再

次总结了国外一些国家在政府信息公开方面的一些做法以及我们需要借鉴的地

方。最后在借鉴国外成功经验的基础上，针对上海政府信息公开目前的现状，从

转变政府官员和公众的思想观念、拓宽政府信息公开的范围、完善政府信息公开

监督救济制度、发挥第三方组织的作用以及加快电子政府建设等方面提出了一些

对策建议。希望能有助于上海政府信息公开工作的有效开展，对全国其它城市的

政府信息公开工作也起到一定的借鉴参考作用。

ABSTRACT

In modern times,alone the improvement of technology,economy and knowledge,

information comes to be important resourement more and more .The government

information is particularly important, because the government control 80% of the useful

information.So the government information publicity has aroused extensive concern in

all sectors of society . In particular, in today's world due to the presence of a variety of

factors, natural disasters and endless variety of complex social events, such as

earthquakes, tsunamis, bird flu and a variety of terrorist incidents, which also asked the

Government to timely disclosure of all information available, increase the Government's

transparency, so that the public can keep abreast of developments, reducing the resulting

fear and enhance trust in government, thereby enhancing the government's

credibility. So all governments have strengthened the government's attention of

information disclosure, and the government information disclosure as the core of

government reform, the researchment of government information disclosure has also

become an important research topic at home and abroad.

Information disclosure in both theory and practice have made great achievements

in western countries. The study of our government information disclosure is still in its

initial stage. In 2005, the Third Session of the Tenth National People's Congress, when

Premier Wen Jiabao talked about striving to build a service-oriented government in

"Government Work Report," Wen Jiabao said: vigorously promote openness in

government affairs and strengthen e-government building, and increase transparency of

government work to improve the Government's credibility. In April 2007, China

published the "The People's Republic of China on Open Government Information", and

the "The People's Republic of China on Open Government Information" shall come into

operation from May 1, 2008.It can be said that is a major "milestone"of our government

information disclosure building. The ordinance of government information based on

"the principle of open, non-disclosure as an exception" ,maximum open government

information and services that reflect the Government to perform its regulatory functions,

and public information on the Government to do a mandatory requirement. In 2004

Shanghai issued the "Shanghai government information disclosure requirements," began

the trial of government information public.It has made great success in five years time,

but there is a definite gap between our government information disclosure with foreign.

Firstly this thesis provides concepts and the basic theory of the government

information disclosure, and it has an important significance in promoting economic

development and realizing people as the masters, improving the Government's

credibility and preventing corruption, and promoting administration by law and reform

the government management.Secondly, it analysis the current status of the Shanghai

government to implement the Government information disclosure, Shanghai,

organizational structure and supporting systems have achieved some success, but the

depth of public the contents 、the improvement of monitoring system, e-government

development still need further improvement. Again it summarizes a number of

government information disclosure practices of some foreign countries, and we need to

learn somethings. Finally, It presents some pieces of advice on developing the Shanghai

government information publicity, including the transformation of government officials

and the public's ideas and broaden the scope of the government information disclosure,

improvement the public oversight of government information relief , the third-party

organizations role and speed up the construction of e-government. Hopes to contribute

to the Shanghai government information disclosure work efficiently and also it plays a

certain reference on other cities across the country the government information

disclosure work.
