摘要
国以民为本,民以食为天。食品安全是人类生存与发展的前提,不仅关系民
众的身体健康、经济健康发展和社会的和谐稳定,而且关系到国家和政府的形象。
但是,近十几年来,我国食品安全事件频频发生,食品的质量安全问题日益严峻,
严重侵害了人们的身体健康和经济的持续稳定发展,致使人们对生活中的饮食缺
乏安全感。因此,加强对食品安全的规制迫在眉睫。为此,笔者从社会中间层主
体的角度对食品安全的规制进行研究,通过对国外一些国家的食品安全领域社会
中间层主体法律规制的制度体系比较研究(本文所讲的食品安全领域社会中间层
主体法律规制,是指社会中间层主体的理论在食品领域的应用,即社会中间层主
体作为规制主体,对食品安全规制发挥作用),尝试对我国食品安全社会中间层
主体法律规制的构建进行探讨,以期能够对我国食品安全法律规制的理论研究有
所裨益。
研究的内容主要分为四个部分:
第一部分介绍了食品安全规制的基础理论,对一些基本概念进行界定,为下
文作铺垫;对我国目前食品安全领域存在的问题加以分析,分析我国目前食品安
全问题发生的原因,主要分析了政府失灵、市场失灵和社会中间层主体的缺失。
第二部分介绍社会中间层主体的基本理论,主要详细介绍社会中间层主体的
产生和发展、内涵、功能和特征,社会中间层主体与政府的关系,社会中间层主
体与市场主体的关系以及社会中间层主体的相互关系,并对社会中间层主体的种
类和功能以及社会中间层主体法律规制理论进行阐述。
第三部分介绍国外食品安全社会中间层主体法律规制的具体实践,主要介绍
具有典型意义的三个国家:美国、德国和日本的做法,通过对这些市场经济比较
成熟的国家食品安全领域社会中间层主体法律规制现状的介绍,为建立我国食品
安全领域社会中间层主体法律规制制度提供借鉴。
第四部分介绍我国食品安全领域社会中间层主体法律规制的具体法律制度
的构建,包括食品安全社会中间层主体体系的建立,食品安全社会中间层主体的
具体规制职权的构建及其实现方式,以及食品安全社会中间层主体在我国的发展
需要不断地培育和监督管理,包括整个管理体制的完善、法律地位的明确和从业
人员的培养。
本文的基本观点:通过对目前食品安全现状及监管存在问题的具体分析,运
用社会中间层主体的基本理论,对国外食品安全社会中间层主体法律规制的实践
的借鉴,尝试在我国建立起食品安全领域社会中间层主体法律规制的具体制度。

本文是对社会中间层主体规制问题所进行的一次探讨和创新尝试,以经济法理论
为基础,以社会中间层主体的现实发展状态为依据,探讨我国食品安全领域社会
中间层主体规制的基本法理、规制体系、规制权的实现途径等几方面的问题。
本文主要运用比较分析、规范分析、法解释学和历史分析等方法,从社会中
间层主体这一角度对食品安全的法律规制问题进行研究,并提出自己的观点。
本文的力图创新之处在于:首先是选题的新意,因为就目前对食品安全问题
的研究来看,大多集中在政策层面和政府监管的角度进行分析,从社会中间层主
体这一角度来研究食品安全规制的比较少;其次,运用社会中间层主体的理论,
完善我国食品安全中观和微观规制制度和体系,有着一定的理论创新意义。
本文的实际应用价值:目前政府在食品安全规制方面已经取得了卓有成效的
效果,但是整个食品安全规制体系缺乏多元性、互动性、参与性和开放性。通过
对社会中间层主体在食品安全规制体系中应有作用的研究,可以弥补食品安全市
场失灵与政府失灵的缺陷,在政府与市场之间建立一种良性的沟通和互动关系,
共同构筑食品安全的牢固防线。对食品安全的社会中间层主体法律规制的研究,
有利于保护民众基本权益,维护社会秩序稳定,保障经济可持续发展,对构建社
会主义和谐社会具有现实价值。

ABSTRACT
State Serving the Community, Hunger breeds discontent. Food safety is a
prerequisite for human survival and development, food security not only for people's
physical health, healthy economic development and social harmony and stability, but
also to the national and the government's image. However, in recent 10 years, China's
food safety incidents occur frequently, food quality and safety is becoming
increasingly serious, serious violations of people's health and the sustained and stable
development of the economy, leading to people's lives in food insecurity. Therefore,
the strengthening of food safety regulation imminent. To this end, the author from a
social point of view of the middle layer of the main regulatory system for food safety
